Lasting Powers of Attorney
A Lasting Power of Attorney, or “LPA” as it is sometimes abbreviated to, is a legal document enabling you to appoint Attorneys to make decisions and sign any documentation on your behalf.
The attorney will have complete powers over your affairs should you lose your mental capacity. When selecting your attorney(s), you need to nominate someone you can completely trust 100% e.g. a close family member or trusted friend. An LPA can only be revoked as long as you have mental capacity.
An LPA can only be used once it is registered with the Office of the Public Guardian (OPG). The registration period takes approximately 1-3months and costs £130.00 in registration fees.
There are two types of LPA, one relating to “Property and Finance” and the other to “Personal Welfare”. Generally the Property and Finance LPA is the more common form of LPA.
General Power of Attorney
There are also “General Power of Attorney” (GPA) documents, which are similar to LPAs but which can only be used whilst the person making the power of attorney, has sound mind. If you cannot wait for the LPA registration period of 1-3 months, then you may instruct us to prepare a GPA, for immediate use.
